A Bethlehem Area School District employee charged with masturbating while he drove on Route 33 offered a unique excuse through his attorney in the lead up to being accepted into a first-offender program on Tuesday, authorities said.
Guy Labar, 48, of East Stroudsburg claimed it was a case not of lewdness, but of "manscaping" gone wrong, said Northampton County District Attorney John Morganelli, using a slang term for male grooming.
"The witness didn't see any manscaping going on," added Assistant District Attorney Patricia Mulqueen, who prosecuted the case.
Accepted into Accelerated Rehabilitative Disposition, Labar will avoid a criminal record if he completes two years of probation and pays court costs and fines.
Labar was assistant supervisor of transportation for the Bethlehem district when he was charged last year with indecent exposure, open lewdness and disorderly conduct. Superintendent Joseph Roy said Tuesday that Labar has resigned his position.
State police said that early on Oct. 24, Labar exposed himself to a truck driver on Route 33 in Bushkill Township near the Wind Gap exit.
Labar had his car's dome light on and sped up and slowed down as the truck driver did, police said. In an interview with a trooper, Labar admitted he was driving with his genitals exposed, according to court records.
His defense attorney, James Swetz, has argued there was another side to the story, saying that "looks can be deceiving" but declining to comment further.
Swetz did not return a phone call seeking comment Tuesday.
Under accelerated rehabilitation, Labar's record will be expunged if he fulfills the program's requirements. Morganelli said indecent exposure cases are typically permitted into it when a defendant has no prior record.
"We've allowed those cases in numerous times," Morganelli said. "It's a misdemeanor."
Another school employee accused of wrongdoing was also accepted into accelerated rehabilitation on Tuesday.
Richard G. Bogdanski, 25, of Bethlehem was charged in November with stealing about $130 from the Wilson Area School District by adding hours to his time cards, police said.
Bogdanski, who served as payroll secretary, no longer works for the district, according to court records. He'll have one year of probation.
